1. Acceptance of these terms

These Terms of Service are an agreement between you and Webtoza (Pty) Ltd, which operates MailerJson ("we", "us"). By creating an account, using our API or using our website, you agree to these terms.

If you are using MailerJson on behalf of a business, you confirm that you have the authority to accept these terms for that business. If you do not agree to them, do not use the service.

2. The service

MailerJson is an email API. You send an email by making a request to our API, and we queue it, deliver it and keep a record of what happened to it. We also provide a dashboard, email templates, workspaces and a virtual sandbox for testing.

We may improve, change or add features over time. We will try to give notice of changes that significantly affect how you use the service.

3. Accounts and API keys

You need an account to use MailerJson. You must give us accurate information and keep it up to date. You are responsible for everything that happens under your account.

Your API keys let anyone who holds them send email on your behalf. Keep them secret and store them on your server, never in code that runs in the browser. If you think a key has been exposed, replace it straight away. We are not responsible for emails sent or credits used by someone who has your key.

4. Sandbox and production

The virtual sandbox is for testing. Emails sent with a sandbox key are intercepted and displayed inside the sandbox. They are not delivered to the recipient, and they do not use credits. There is no limit on how many emails you can send to the sandbox.

Production keys come from the production dashboard. Emails sent with a production key are delivered to real recipients and use credits. You are responsible for making sure you are using the right key.

5. Credits, pricing and payment

MailerJson has no monthly plan. You buy credits and each production email uses credits. The current price, which is R3,50 per 1000 credits at the time of writing, is shown on our pricing page. Payments are processed by Paystack.

We may change our prices. A price change applies to credits you buy after the change and does not affect credits you have already bought.

6. Acceptable use

You are responsible for the emails you send and for having the right to send them. You agree that you will not use MailerJson to:

  • Send spam or unsolicited bulk email, or send to people who have not agreed to hear from you where the law requires their consent.
  • Send anything unlawful, fraudulent, misleading or harmful, including phishing, malware or content that infringes someone else's rights.
  • Impersonate another person or organisation, or send from an address or domain you do not control.
  • Attempt to break, overload or gain unauthorised access to the service or to other people's accounts.
  • Resell or share your access in a way that avoids our pricing or limits.

You must follow the laws that apply to your emails and your recipients, including the Protection of Personal Information Act (POPIA) and the rules on unsolicited electronic messages.

7. Your content and data

You keep ownership of the content you send through MailerJson. You give us permission to process, store and deliver that content only as needed to run the service for you.

We keep a record of your production emails, including delivery status, for 30 days, after which it is deleted. You are responsible for keeping any copies you need.

Where you send personal information about your recipients through MailerJson, you are responsible for having a lawful basis to do so. [CONFIRM: add a link to your privacy policy and describe how you act as an operator under POPIA.]

8. Availability and changes

We work to keep MailerJson running and your emails moving, but we cannot promise that the service will always be uninterrupted or error free. Email delivery also depends on other systems that we do not control, such as recipients' mail providers.

We may carry out maintenance, and we may change or discontinue features. Where we can, we will warn you in advance.

9. Suspension and termination

You can stop using MailerJson and close your account at any time.

We may suspend or close your account if you break these terms, if your use puts the service or other customers at risk, or if we are required to by law. Where it is reasonable to do so, we will tell you why and give you a chance to fix the problem first.

10. Warranties and liability

MailerJson is provided "as is". To the extent the law allows, we do not give any promise that the service will meet your particular needs or that emails will always be delivered or opened.

To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits or lost business. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose.

Nothing in these terms limits any right you have under law that cannot be excluded, including under the Consumer Protection Act where it applies.

11. Governing law

These terms are governed by the laws of the Republic of South Africa. [CONFIRM: add the court or dispute process you want to use.]

We may update these terms from time to time. When we make a significant change we will update the date at the top of this page and, where appropriate, notify you. If you keep using MailerJson after a change takes effect, you accept the new terms.
